![]() early release and sale of electronic stuff? A few years ago I was at an FYE store and saw a dvd on the shelf that wasnt supposed to be out yet. It was 4 or 5 days early so I grabbed(I had been waiting for a long time) and went to buy it. The guy behind the counter knew what it was and asked where I got it and I said "over there, it was on the shelf." It got really mad and yelled at someone to take them down and told me since I had it in hand he was required to sell it to me. lately though I have been to a few places where a game or a movie breaks street date and even though I have them in hand the places wont sell them to me. If you as a customer pick something off the shelf, are stores required to sell them to you regardless of the date of release? The store is probably under a contractual obligation to hold the item until the release date. Violating that contract might trigger a damage clause or jeopardize their ability to sell future releases from the distributor. It's possible that they don't yet own the item even though they are in possession. You can't force a store to sell you something that they can't legally sell. The clerk at FYE made a mistake for which he could have been fired. A purchase transaction consists of an offer (to buy or sell), an acceptance (of the offer), and a consideration (money or an item in return) that is acceptable and agreed to by both parties. Simply abandoning your money on the counter and walking out the door with the item is not a transaction since one or more of the conditions have not been met. Furthermore, you could find yourself facing not only criminal charges, but a civil lawsuit from an injured party with deep pockets. Don |
